{"id":54866,"date":"2023-12-13T18:04:29","date_gmt":"2023-12-13T18:04:29","guid":{"rendered":"https:\/\/prosfunds.com\/politics\/trump-lawyers-say-special-counsel-is-a-grinch-who-would-ruin-holidays-for-attorneys\/"},"modified":"2023-12-13T18:04:30","modified_gmt":"2023-12-13T18:04:30","slug":"trump-lawyers-say-special-counsel-is-a-grinch-who-would-ruin-holidays-for-attorneys","status":"publish","type":"post","link":"https:\/\/prosfunds.com\/?p=54866","title":{"rendered":"Trump lawyers say special counsel is a Grinch who would ruin holidays for attorneys"},"content":{"rendered":"<div data-editable=\"content\" itemprop=\"articleBody\" data-reorderable=\"content\">\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/clq3zba9s000i64oybono96k2@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      Former President Donald Trump\u2019s lawyers compared special counsel Jack Smith to the\u00a0Grinch\u00a0in a court filing Wednesday for trying to expedite the appeals process in one of his criminal cases, saying that prosecutors are trying to disrupt their holiday travel plans and to \u201cdisenfranchise\u201d voters in 2024.\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/clq41wh6a000f3b6hfud949xe@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      Earlier this week, Smith\u2019s team asked the DC US Circuit Court of Appeals to expedite its review of whether Trump has any immunity from criminal prosecution for alleged crimes he committed while in office.\u00a0The issue was raised in the 2020 election subversion criminal case against Trump, who also has been indicted by Smith\u2019s office for alleged mishandling of national security secrets.\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/clq41wh6a000g3b6himv1rc7b@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      \u201cThe prosecution has one goal in this case: To unlawfully attempt to try, convict, and sentence President Trump before an election in which he is likely to defeat President Biden,\u201d defense attorneys wrote in the filing. \u201cThis represents a blatant attempt to interfere with the 2024 presidential election and to disenfranchise the tens of millions of voters who support President Trump\u2019s candidacy.\u201d\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/clq41wh6a000h3b6h4nohjgnt@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      They continued, \u201cThis proposed schedule would require attorneys and support staff to work round-the-clock through the holidays, inevitably disrupting family and travel plans. It is as if the Special Counsel \u201cgrowled, with his\u00a0Grinch\u00a0fingers nervously drumming, \u2018I must find some way to keep Christmas from coming. \u2026 But how?\u2019\u201d\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/clq41wh6a000i3b6h9p0c2hob@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      Smith and Trump have repeatedly butted heads over the pace of the criminal case, and when the trial will actually take place. Though the trial is currently scheduled to take place in March 2024, defense lawyers have consistently pushed to delay the trial until after the election.\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/clq41wh6a000j3b6h74h2u8jz@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      A spokesperson for Smith declined to comment.\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/clq41wh6a000k3b6hvdhws7qq@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      In addition to the appeals court, Smith\u2019s team has asked\u00a0the Supreme Court\u00a0to review\u00a0District Judge\u2019s Tanya Chutkan\u2019s ruling\u00a0that as a former president, Trump is not immune from the election subversion prosecution brought in Washington, DC. Lawyers for the former president have argued that Trump\u2019s alleged actions over the 2020 election results were part of his official duties at the time and therefore he is protected by presidential immunity.\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/clq41wh6a000l3b6hzf57mq4b@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      Prosecutors also asked the courts to decide whether Trump is protected by double jeopardy.
