{"id":53482,"date":"2023-12-07T18:16:11","date_gmt":"2023-12-07T18:16:11","guid":{"rendered":"https:\/\/prosfunds.com\/business\/yellowstone-creator-and-actor-battle-over-coffee-companys-logo\/"},"modified":"2023-12-07T18:16:12","modified_gmt":"2023-12-07T18:16:12","slug":"yellowstone-creator-and-actor-battle-over-coffee-companys-logo","status":"publish","type":"post","link":"https:\/\/prosfunds.com\/?p=53482","title":{"rendered":"\u2018Yellowstone\u2019 creator and actor battle over coffee company\u2019s logo"},"content":{"rendered":"<div data-editable=\"content\" itemprop=\"articleBody\" data-reorderable=\"content\">\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/clpv7hwkb002583pdchkh1zob@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      A very real legal drama over coffee is brewing on the set of a fictional TV show.\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/clpv7ll6f00023b6h2js89lx8@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      The ranch of Tyler Sheridan, who is the showrunner and creator of the hit TV show \u201cYellowstone,\u201d is suing the coffee brand created by Cole Hauser, one of the show\u2019s<strong> <\/strong>actors, for \u201ctrademark infringement, unfair competition and false advertising\u201d over the logo used for Hauser\u2019s new coffee company.\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/clpv7og2q00053b6he83p3ojj@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      In the lawsuit filed last month, Sheridan\u2019s ranch argues that the logo for its Bosque Ranch Craft Coffee, named after his ranch in Texas, is similar to that of Hauser\u2019s coffee brand, Free Rein, because they both have \u201ctwo overlapping letters.\u201d\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/clpv84g97000o3b6hn2lae6i3@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      Bosque Ranch has been using the overlapping \u201cBR\u201d logo since 2004 and launched a coffee lineup in June 2023. In October, Free Rein coffee was created and started using a logo with the \u201cFR\u201d letters overlapping for one of its logos.\n  <\/p>\n<div data-uri=\"cms.cnn.com\/_components\/image\/instances\/clpved2jj00263b6hzkqle93b@published\" class=\"image image__hide-placeholder\" data-image-variation=\"image\" data-name=\"Unknown copy.jpg\" data-component-name=\"image\" data-observe-re data-breakpoints=\"{\" image--eq-extra-small=\"\" data-original-ratio=\"0.4267161410018553\" data-original-height=\"460\" data-original-width=\"1078\" data-url=\"https:\/\/media.cnn.com\/api\/v1\/images\/stellar\/prod\/unknown-copy-20231207161803230.jpg?c=original\" data-editable=\"settings\">\n<div class=\"image__container \" data-image-variation=\"image\" data-breakpoints=\"{\" image--eq-extra-small=\"\">\n       <picture class=\"image__picture\"><source height=\"460\" width=\"1078\" media=\"(min-width: 1280px)\"  type=\"image\/webp\"><source height=\"460\" width=\"1078\" media=\"(min-width: 960px)\"  type=\"image\/webp\"><source height=\"460\" width=\"1078\" media=\"(min-width: 480px)\"  type=\"image\/webp\"><source height=\"460\" width=\"1078\" media=\"(max-width: 479px)\"  type=\"image\/webp\"><\/source><\/source><\/source><\/source><\/picture>\n    <\/div>\n<\/div>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/clpv7uw7p00073b6hskdseiph@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      Sheridan\u2019s ranch claims that Hauser and his coffee company had not \u201casked or received permission or authorization\u201d from Sheridan \u201cto use a mark confusingly similar to the \u2018BR\u2019 brand for virtually identical goods.\u201d It added that the<strong> <\/strong>logo is \u201clikely to cause confusion or to cause mistake or to deceive as to the affiliation, connection, or association\u201d with Bosque Ranch.\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/clpv82ds7000j3b6h3tqhnuf0@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      Bosque Ranch, which Sheridan has owned for nearly 20 years, is seeking an injunction against Hauser\u2019s brand along with damages and profits from Free Rein. It\u2019s also demanding the company \u201cdestroy all products, marketing, and promotional materials displaying\u201d the logo.\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/clpvc5uht00113b6hekokzmmn@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      Free Rein didn\u2019t immediately return CNN\u2019s request for comment.\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/clpvc84f800133b6hnfmz5zr1@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      Attorney Josh Gerben told CNN that trademark infringement cases are \u201ctypically very close calls and depend heavily on the evidence the parties are able to bring forth in trial.\u201d\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/clpvcc370001d3b6h8hg7jca8@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      A judge or jury will have to make a determination if the \u201caverage consumer might be confused into purchasing the Free Reign Coffee product when it was seeking to buy a Bosque Ranch Craft Coffee product,\u201d he said.\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/clpvckfs3001u3b6hh24hfivx@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      For example, if other coffee brands have similar logos with overlapping letters, Gerben said the case would be weak for Bosque Ranch because there would be a \u201ccrowded marketplace of similar trademarks\u201d that would show shoppers aren\u2019t looking at just the logo or a two-letter acronym when picking a coffee brand.\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/clpvcb5s5001a3b6ha38ixkmo@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      \u201cI do not consider this to be a slam-dunk case and think a decision would be a close call for any judge or jury,\u201d Gerben said, who is not involved in the case.\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/clpvcellz001o3b6hmckmv0xa@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      As for a lawsuit between two co-workers, Gerben said it\u2019s a \u201clittle surprising to see\u201d since he thinks there was \u201cclearly an opportunity for settlement discussions to take place.\u201d Sheridan filing a federal lawsuit suggests the ranch felt that settlement discussions \u201cwere not obtaining the result it desired,\u201d Gerben added.\n  <\/p>\n<\/p><\/div>\n<p>Read the full article <a href=\"https:\/\/www.cnn.com\/2023\/12\/07\/food\/yellowstone-coffee-lawsuit\/index.html\" target=\"_blank\" rel=\"noopener\">here<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>A very real legal drama over coffee is brewing on the set of a fictional TV show.
