A group of think tanks are pushing a federal court to block the Biden administration’s plans to cancel $39 billion in student loan debt for 800,000 borrowers.<\/p>\n

The New Civil Liberties Alliance filed a lawsuit in Michigan on behalf of the Mackinac Center for Public Policy and the Cato Institute. The groups argued that the Biden administration was overstepping its authority in initiating changes to how payments are treated under income-driven repayment (IDR) plans. These plans are designed to align with borrowers’ incomes and to forgive debt for those who’ve accumulated the equivalent of either 20 or 25 years of qualifying monthly payments. But the Biden administration said flaws in these plans’ framework meant some borrowers’ payments were not counted as progress toward forgiveness.\u00a0<\/p>\n

“These fixes are part of the Department\u2019s commitment to address historical failures in the administration of the Federal student loan program in which qualifying payments made under IDR plans that should have moved borrowers closer to forgiveness were not accounted for,” the Education Department said in a statement.\u00a0<\/p>\n

The department’s one-time adjustment includes changes that would count certain periods of past partial payments as progress toward forgiveness. The adjustment applies to IDR-qualifying payments for all William D. Ford Federal Direct Loan (Direct Loan) Program and federally owned Federal Family Education Loan (FFEL) Program loans.<\/p>\n

But plaintiffs argued that these changes were illegal because it was not authorized by Congress and avoided a federal rulemaking process that welcomes public feedback.<\/p>\n

“No authority allows the Department to count non-payments as payments,” the lawsuit said.<\/p>\n

The Education Department maintained its moves were justified in fixing existing issues.\u00a0<\/p>\n

“For far too long, borrowers fell through the cracks of a broken system that failed to keep accurate track of their progress towards forgiveness,” Secretary of Education Miguel Cardona said in a statement. “By fixing past administrative failures, we are ensuring everyone gets the forgiveness they deserve, just as we have done for public servants, students who were cheated by their colleges and borrowers with permanent disabilities, including veterans. This administration will not stop fighting to level the playing field in higher education.”<\/p>\n

Previously, the Supreme Court shut down President Joe Biden’s wide-reaching student loan forgiveness plan<\/u>. That move would have forgiven $10,000 in student loan debt for lower-to-middle income borrowers and up to $20,000 for those who also received Pell Grants. The law could have wiped out $441 billion in outstanding student debt, according to an estimate by the Federal Reserve Bank of New York.\u00a0<\/p>\n
