The groups argued that the Biden administration was overstepping its authority in initiating changes to how payments are treated under income-driven repayment (IDR) plans. These plans are designed to align with borrowers&#8217; incomes and to forgive debt for those who&#8217;ve accumulated the equivalent of either 20 or 25 years of qualifying monthly payments. But the Biden administration said flaws in these plans&#8217; framework meant some borrowers&#8217; payments were not counted as progress toward forgiveness.\u00a0<\/p>\n<p>&#8220;These fixes are part of the Department\u2019s commitment to address historical failures in the administration of the Federal student loan program in which qualifying payments made under IDR plans that should have moved borrowers closer to forgiveness were not accounted for,&#8221; the Education Department said in a statement.\u00a0<\/p>\n<p>The department&#8217;s one-time adjustment includes changes that would count certain periods of past partial payments as progress toward forgiveness. The adjustment applies to IDR-qualifying payments for all William D. Ford Federal Direct Loan (Direct Loan) Program and federally owned Federal Family Education Loan (FFEL) Program loans.<\/p>\n<p>But plaintiffs argued that these changes were illegal because it was not authorized by Congress and avoided a federal rulemaking process that welcomes public feedback.<\/p>\n<p>&#8220;No authority allows the Department to count non-payments as payments,&#8221; the lawsuit said.<\/p>\n<p>The Education Department maintained its moves were justified in fixing existing issues.\u00a0<\/p>\n<p>&#8220;For far too long, borrowers fell through the cracks of a broken system that failed to keep accurate track of their progress towards forgiveness,&#8221; Secretary of Education Miguel Cardona said in a statement. &#8220;By fixing past administrative failures, we are ensuring everyone gets the forgiveness they deserve, just as we have done for public servants, students who were cheated by their colleges and borrowers with permanent disabilities, including veterans. This administration will not stop fighting to level the playing field in higher education.&#8221;<\/p>\n<p>Previously, the Supreme Court shut down President Joe Biden&#8217;s wide-reaching <u>student loan forgiveness plan<\/u>. That move would have forgiven $10,000 in student loan debt for lower-to-middle income borrowers and up to $20,000 for those who also received Pell Grants. Visit Credible to get your personalized rate in minutes without affecting your credit score.\u00a0<\/p>\n<p><strong><u>BIDEN ASKS STUDENT LOAN COMPANIES TO PREPARE FOR END TO PAYMENT PAUSE<\/u><\/strong>\u00a0<\/p>\n<h2>Adjustment to Income-driven repayment plans\u00a0<\/h2>\n<p>As part of the Department of Education\u2019s one time payment count adjustment to IDR plans, the initiative credited payments made during any of the following periods.\u00a0<\/p>\n<ul>\n<li>Any month in which a borrower was in repayment status, regardless of whether payments were partial or late, the type of loan, or the repayment plan\u00a0<\/li>\n<li>Any period in which a borrower spent 12 or more consecutive months in forbearance\u00a0<\/li>\n<li>Any month in forbearance for borrowers who spent 36 or more cumulative months in forbearance\u00a0<\/li>\n<li>Any month spent in deferment (except for in-school deferment) prior to 2013\u00a0<\/li>\n<li>Any month spent in economic hardship or military deferments on or after January 1, 2013<\/li>\n<\/ul>\n<p>&#8220;Inaccurate payment counts have resulted in borrowers losing hard-earned progress toward loan forgiveness,&#8221; the Department of Education stated. &#8220;This action also addresses concerns about practices by loan servicers that put borrowers into forbearance in violation of Department rules. The Department previously began discharging loans for borrowers who reached forgiveness for Public Service Loan Forgiveness (PSLF) through these changes.&#8221;\u00a0\u00a0\u00a0<\/p>\n<p>If you hold private student loans, you won\u2019t be able to enroll in a federal income-driven repayment plan, but you could refinance your loans into a lower interest rate. The Saving on a Valuable Education (SAVE) plan could reduce borrowers\u2019 monthly payments to zero, lower monthly payments in half or save those that do make payments at least $1,000 a year, the White House said. Borrowers can enroll in SAVE this summer before the repayment pause ends.\u00a0<\/p>\n<p>In addition, the Education Department rolled out its 12-month &#8220;on-ramp&#8221; program set to run from Oct. 1 to Sep. 30, 2024.\u00a0<\/p>\n<p>&#8220;Financially vulnerable borrowers who miss monthly payments during this period are not considered delinquent, reported to credit bureaus, placed in default or referred to debt collection agencies,&#8221; the White House said in a statement.<\/p>\n<p>Still, interest on student loans would accrue.\u00a0<\/p>\n<p>The Biden administration is still attempting to provide widespread student loan forgiveness. In fact, it\u2019s currently trying to pass its initial student loan forgiveness plan under the Higher Education Act.
