Opponents hope Ohio\u2019s Issue 1 offers a reset"},"content":{"rendered":"<div data-editable=\"content\" itemprop=\"articleBody\" data-reorderable=\"content\">\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/clodehyju003627p42r6aai2p@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      When polls close on November 7, Ohio will either become the latest state to enshrine abortion rights into its constitution or enter a period of uncertainty as the state Supreme Court considers allowing a six-week abortion ban to be enforced.\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/clodfb5hk00083b6h035khb4i@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      For Joel Spring, a 33-year-old from West Chester, neither option seems ideal.\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/clodfb5hl00093b6h1trtotk4@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      Spring said he\u2019s \u201cpro-life\u201d but also thinks \u201cwe\u00a0have\u00a0to have some legal abortion,\u201d with a cutoff somewhere in the first or second trimester. The state\u2019s six-week ban went too far,\u00a0he said,\u00a0but so does Issue 1, a ballot initiative that would prevent the state from restricting abortion access before fetal viability, which doctors generally consider to be around 22 to 24 weeks of pregnancy.\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/clodfb5hl000a3b6hbi52jz80@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      \u201cI think there needs to be a balance.\u00a0Unfortunately, when it comes to the issue of abortion, you\u2019re either one extreme or the other,\u201d Spring, who voted\u00a0\u201cno\u201d\u00a0on the abortion amendment, said after casting his ballot early at his local county\u00a0board of elections. \u201cI don\u2019t really know what the solution is.\u201d\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/clodfb5hl000b3b6hz8ibxezs@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      Ohio\u2019s Issue 1 could drastically reshape reproductive rights in a state where Republican leaders have proposed legislation to completely ban abortion post-Roe. But it will also serve as a bellwether for 2024, suggesting what strategies and messages will resonate most with voters during a general election in which Democrats will make abortion a key issue.\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/clodfb5hl000c3b6hvgny7jmq@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      After a string of defeats in last year\u2019s midterm elections, anti-abortion groups at the state and national level hope\u00a0the Buckeye State\u00a0will offer a new playbook as abortion advocates seek to introduce similar initiatives to undo strict bans in other red states. Abortion opponents argue\u00a0that\u00a0groups such as Planned Parenthood and the ACLU, which have been working on the ballot strategy, were more prepared after the Supreme Court overturned\u00a0Roe v. Wade last year and erased\u00a0federal abortion protections.\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/clodfb5hl000d3b6hjd4ndb1a@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      \u201cWe felt it was imperative to get together with the in-state pro-life leaders\u00a0and the pro-life coalitions\u00a0from all across Ohio and help build a model to fight back,\u201d said Stephen Billy, the vice president of state affairs at Susan B. Anthony Pro-Life America, an anti-abortion advocacy group. \u201cWhen you work with a unified pro-life movement, alongside political leadership in the state, you have an opportunity to have an impact and defeat these amendments.\u201d\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/clodfb5hl000e3b6h8lfvsvjx@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      Last year voters in Michigan, Vermont and California voted to add abortion protections to their state constitutions, while Kansas, Kentucky\u00a0and Montana voters rejected efforts to roll access back. Abortion advocates are working to get initiatives on the 2024 ballot in states including Arizona, Colorado, Nevada, Florida, South Dakota and Nebraska.\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/clodfb5hl000f3b6hgxf5dexr@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      In Ohio,\u00a0abortion rights advocates defeated a ballot initiative in August that would have raised the threshold to amend the constitution from a simple majority to 60%. Now, after urging voters to vote \u201cno\u201d on the August amendment \u2013 also called Issue 1 \u2013 they are urging people to vote \u201cyes\u201d on the November version, a switch that has caused some confusion with voters.\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/clodfb5hl000g3b6hy457o2ye@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      Abortion opponents say that the defeat of the August measure to change the constitution \u2013 which was opposed by 57% of voters \u2013 isn\u2019t a sign the November abortion initiative will pass. Supporters aren\u2019t taking it that way, either.\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/clodfb5hl000h3b6hiu0y0b1t@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      \u201cI don\u2019t think you can look at any election as a given, although the vast majority of Ohioans obviously support abortion access,\u201d said Kellie Copeland, the executive director of Pro-Choice Ohio.\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/clodfb5hl000i3b6h0spahp1e@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      As of Thursday, more than 380,000 Ohioans had cast their ballots early, according to absentee voter reports from the secretary of state\u2019s office.\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/clodfb5hl000j3b6hjwp1t3w3@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      Abortion rights groups have outraised opponents and outspent them on TV. Ohioans United for Reproductive Rights, the main coalition supporting Issue 1, has raised $28.7 million for the general election, compared with $9.9 million raised by Protect Women Ohio, the main group opposing it, according to campaign finance reports filed Thursday. Since Labor Day, Democratic groups backing Issue 1 have spent more than $20 million in ads, compared with $8.5 million spent by groups opposing Issue 1, according to data from AdImpact.\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/clodfb5ho000k3b6h3lwd7d2m@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      The \u201cyes\u201d coalition sued the Ohio Ballot Board and Republican Secretary of\u00a0State Frank LaRose\u00a0in August\u00a0over\u00a0how the state described\u00a0the proposed amendment on ballots, arguing the summarized text aimed to \u201cmislead Ohioans and persuade them to oppose\u201d it. The state Supreme Court\u00a0granted the \u201cyes\u201d coalition a partial rewrite,\u00a0but\u00a0ruled against it\u00a0on issues such as the use of \u201cunborn child\u201d over \u201cunborn fetus\u201d and the summary\u2019s exclusion of the proposed amendment\u2019s protections for contraceptive care.\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/clodfb5ho000l3b6hi0trm65k@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      Unlike Michigan,\u00a0which had a Democratic governor, secretary of state and attorney general when it\u00a0passed a very similar abortion rights amendment last year, Ohio Republicans have trifecta control\u00a0of the government, and\u00a0run the offices of attorney general and secretary of state. Those leaders have been deeply involved in trying to defeat the measure.\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/clodfb5ho000m3b6hz4nuymc6@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      Gov.\u00a0Mike DeWine, who won reelection last year by 25 points against a Democrat who supported abortion access, cut a TV ad urging Ohioans to vote \u201cno\u201d on Issue 1, which he\u2019s said is too extreme for the state. Attorney General\u00a0Dave Yost released a legal analysis of the amendment\u00a0that\u00a0argued\u00a0it went \u201cfurther\u201d than the protections in Roe and could overturn parental consent laws for minors seeking abortions.\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/clodfb5ho000n3b6h80n7bfh5@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      Nationally, the state\u2019s anti-abortion coalition has received more than $15 million from Susan B. Anthony Pro-Life America for both the August and November Issue 1 initiatives, according to campaign finance records.\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/clodfb5ho000o3b6h4643nnvc@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      Under current Ohio law, abortion is legal before 22 weeks of pregnancy. But that could change depending on the fate of a six-week abortion ban signed into law by DeWine in 2019. The \u201cheartbeat bill,\u201d which bans the procedure after fetal cardiac activity is detected, was blocked by a federal court at the time. The court\u00a0then, at the behest of Yost,\u00a0lifted the injunction against the law hours after the Supreme Court overturned Roe.\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/clodfb5ho000p3b6h9zj5j8bl@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      The six-week ban, which included no exceptions for rape or incest victims, was in effect from June to September 2022, before it was paused by a court. Among those affected was\u00a0a 10-year-old rape victim\u00a0who had to travel to Indiana to get an abortion. It\u2019s now being considered by the state Supreme Court.\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/clodfb5ho000q3b6hwkjlrldq@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      \u201cIt has really helped illustrate what a \u2018yes\u2019 vote means,\u201d Jordyn Close, the deputy director of the Ohio Women\u2019s Alliance, one of the groups in the coalition backing Issue 1, said of the six-week ban. \u201cWe\u2019re able to say Ohio has experienced this already. Ohio doesn\u2019t want to go back to this.\u201d\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/clodfb5ho000r3b6hsuf6n390@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      Opponents have tried to frame Issue 1 as an extreme in the other direction.\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/clodfb5ho000s3b6hbpugjqnk@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      \u201cPeople have very differing views about at what point in a pregnancy abortion should be permitted, but a very small number of people think that abortion should be permitted at all times, up until the time of birth,\u201d DeWine said in an interview with CNN. \u201cThey\u2019ve just grossly overreached.\u201d\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/clodfb5ho000t3b6hb526hn8p@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      Issue 1 does allow abortion to be prohibited after fetal viability, a point determined by the pregnant patient\u2019s treating physician. However, there are no circumstances under which abortion can be prohibited if the presiding physician deems it \u201cnecessary to protect the pregnant patient\u2019s life or health.\u201d\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/clodfb5hp000u3b6h42xg1r7j@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      Under the state\u2019s six-week ban, abortions are allowed after fetal cardiac activity is detected if the patient\u2019s physician believes one is\u00a0necessary to \u201cavoid a serious risk of the substantial and irreversible impairment of a major bodily function of the pregnant woman\u201d or to prevent the patient\u2019s death.\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/clodfb5hp000v3b6hg4t1tman@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      Most abortions are induced during the first three months of pregnancy. Of the 21,813 abortions performed in Ohio in 2021 \u2014 the year before the six-week ban briefly went into effect \u2014 about 87% were performed before 13 weeks of pregnancy,\u00a0according to data from the Ohio Department of Health.\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/clodfb5hp000w3b6hwxg9n23v@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      Less than 1% were performed after 20 weeks, and none were performed after 24 weeks. The number of abortions in Ohio dropped 15% between 2021 and 2022, according to the department.\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/clodfb5hp000x3b6hnuck3z42@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      DeWine and other Issue 1 opponents have sought to separate the six-week bill from the debate over the ballot initiative, arguing it\u2019s easier to change a state law than it is to amend the state constitution.\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/clodfb5hp000y3b6hcuj08hle@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      \u201cIf we can defeat this amendment, which I\u00a0certainly\u00a0hope we can, it will give us the opportunity in Ohio to try to come up with something that the majority of Ohioans can support,\u201d DeWine said in an interview.\u00a0He said a\u00a0new bill should include exceptions for rape and incest, and that the timeline of the restriction is \u201ccertainly something to be discussed.\u201d\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/clodfb5hp000z3b6ha4badw29@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      But abortion rights advocates say they worry Republicans would go even further than the six-week ban and prohibit all abortions as some states, including neighboring Indiana, have done.\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/clodfb5hp00103b6htjfy9l0u@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      \u201cI have no doubt they will go forward with [a total ban], because that\u2019s always been their agenda,\u201d said Copeland of Pro-Choice Ohio. \u201cThat\u2019s really what\u2019s at stake\u00a0with Issue 1.\u201d\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/clodfb5hp00113b6hhjw26n4k@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      While the \u201cyes\u201d side has pointed to the six-week limit, the \u201cno\u201d side has pointed to Michigan, where Democratic lawmakers have advanced a slate of bills designed to repeal other existing abortion regulations.\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/clodfb5hp00123b6hmph88wg1@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      \u201cThey are providing this perfect test case for us to look at and see what will come to Ohio if Issue 1 passes,\u201d said Amy Natoce, a spokesperson for Protect Women Ohio.\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/clodfb5hp00133b6hxuatvuz5@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      After Michigan\u00a0enshrined abortion\u00a0rights\u00a0in the state constitution and\u00a0Democrats\u00a0won control of government, state lawmakers introduced a package of bills aimed at dropping remaining abortion policies they viewed as restrictive, such as\u00a0the state\u2019s 24-hour waiting period and informed consent form requirement and other requirements\u00a0targeted at abortion clinics.\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/clodfb5hp00143b6h30niu8qy@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      Abortion rights advocates say the regulations are unnecessary hurdles designed to dissuade patients or make it harder for clinics to operate. Opponents say such regulations are about patient safety.\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/clodfb5hp00153b6hnfqkqyfa@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      In\u00a0both\u00a0Michigan and Ohio, abortion opponents argued the constitutional amendments would also eliminate parental consent laws in the state.\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/clodfb5hp00163b6hw33nzquu@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      So far, that hasn\u2019t come to pass in Michigan.\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/clodfb5hp00173b6hndvbbww6@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      While abortions rights advocates have called the consent law unnecessary or outdated, Democratic lawmakers have not introduced legislation to repeal it.\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/clodfb5hp00183b6h6arxc1fl@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      For Shannon Gracen, a 52-year-old from Symmes Township near Cincinnati, it wouldn\u2019t be a bad thing if Ohio followed in Michigan\u2019s footsteps.\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/clodfb5hp00193b6hd1r4n88h@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      \u201cRepublicans are saying, what a mess it is in Michigan because they did this last year,\u201d Gracen said. \u201cAnd it\u2019s just lies.\u201d\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/clodfb5hp001a3b6htgut1588@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      Gracen took her two adult daughters with her to vote early recently, and all three voted\u00a0\u201cyes\u201d\u00a0on Issue 1.\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/clodfb5hp001b3b6hohkrlnlw@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      \u201cWe voted \u2018yes\u2019 because we want to make sure that women have rights,\u201d she said.\n  <\/p>\n<\/p><\/div>\n<p>Read the full article <a href=\"https:\/\/www.cnn.com\/2023\/10\/31\/politics\/ohio-abortion-ballot-measure\/index.html\" target=\"_blank\" rel=\"noopener\">here<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>When polls close on November 7, Ohio will either become the latest state to enshrine abortion rights into its constitution or enter a period of uncertainty as the state Supreme Court considers allowing a six-week abortion ban to be enforced.
