{"id":35697,"date":"2023-10-26T00:33:28","date_gmt":"2023-10-26T00:33:28","guid":{"rendered":"https:\/\/prosfunds.com\/politics\/colorado-judge-paves-way-for-trial-on-whether-14th-amendment-disqualifies-trump-from-office\/"},"modified":"2023-10-26T00:33:30","modified_gmt":"2023-10-26T00:33:30","slug":"colorado-judge-paves-way-for-trial-on-whether-14th-amendment-disqualifies-trump-from-office","status":"publish","type":"post","link":"https:\/\/prosfunds.com\/?p=35697","title":{"rendered":"Colorado judge paves way for trial on whether 14th Amendment disqualifies Trump from office"},"content":{"rendered":"<div data-editable=\"content\" itemprop=\"articleBody\" data-reorderable=\"content\">\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/clo6bnb5q007a67p1fw0ahxi4@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      A Colorado judge has rejected another attempt by former President Donald Trump to\u00a0throw out a lawsuit\u00a0seeking to block him from the 2024 presidential ballot based on the 14th Amendment\u2019s \u201cinsurrectionist ban.\u201d\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/clo6bnyqi00063b6ifsfxcgj1@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      The ruling Wednesday from Colorado District Judge Sarah Wallace clears the way for an unprecedented trial to begin next week, to determine if Trump is disqualified from returning to the White House because of his role in the January 6, 2021, insurrection.\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/clo6bnyqi00073b6i9nqvcmt7@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      This is the\u00a0fifth unsuccessful bid\u00a0by Trump to throw out the Colorado case, which is one of several pending suits trying to derail his candidacy based on the 14th Amendment.\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/clo6bnyqi00083b6ifra5uae7@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      The\u00a014th Amendment, which was ratified after the Civil War, says US officials who take an oath to uphold the Constitution are disqualified from future office if they \u201cengaged in insurrection\u201d or have \u201cgiven aid or comfort\u201d to insurrectionists. But the Constitution does not spell out how to enforce the ban, and it has only been applied twice since the 1800s.\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/clo6bnyqi00093b6iubcish43@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      In a 24-page ruling, Wallace rejected Trump\u2019s argument that questions about his eligibility should be handled by Congress, not courts. She also rejected Trump\u2019s argument that the Colorado election officials don\u2019t have the power to enforce the so-called \u201cinsurrectionist ban,\u201d which is enshrined in Section 3 of the 14th Amendment.\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/clo6bnyqi000a3b6imp7icmce@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      \u201cThe Court holds that states can, and have, applied Section 3 pursuant to state statutes without federal enforcement legislation,\u201d Wallace wrote.\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/clo6bnyqi000b3b6iiyp1kk44@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      She said the trial will focus on several key questions, including whether the events of January 6 \u201cconstituted an insurrection\u201d and whether Trump \u201cengaged\u201d in insurrection.\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/clo6bnyqi000c3b6izb53ra47@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      Trump has denied wrongdoing regarding the January 6 attack on the US Capitol. He pleaded not guilty to state and federal charges stemming from his attempts to overturn the 2020 election.\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/clo6bnyqi000d3b6ilypokpxu@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      His campaign has condemned these \u201cabsurd\u201d lawsuits and said the groups pushing these candidacy challenges are \u201cstretching the law beyond recognition.\u201d\n  <\/p>\n<\/p><\/div>\n<p>Read
